These Terms and Conditions (“Terms”) govern the access and use of the services provided by CoinPay.cr, a brand operated by Raw Industries CCM S.R.L., a company registered in the Republic of Costa Rica, and its duly authorized affiliates or associated providers (hereinafter “CoinPay.CR”, “we”, “us”, “our”).
By registering or using the services, the user (hereinafter “User”) acknowledges having read, understood, and fully accepted these Terms, along with the Privacy Policy, Acceptable Use Policy, and Compliance Policy (KYC/AML), which form an integral part of this document.
CoinPay.CR reserves the right to modify these Terms at any time by notifying users through publication on its website or by electronic means.
Continued use of the services constitutes express acceptance of any modifications.
CoinPay.cr provides digital payment services, global accounts, international transfers, currency conversion, and payment instrument issuance, integrating blockchain technology as a means of fund transfer and settlement.
CoinPay.cr does not offer, promote, or intermediate trading, investment, or speculative operations involving cryptocurrencies or digital assets.
The services are intended exclusively for transactional purposes, aimed at facilitating payments, remittances, and transfers, without offering yield, appreciation, or promises of profitability.
All currency conversions and exchange rates are presented in a clear, documented, and verifiable manner, ensuring full transparency in every operation.
CoinPay.cr operates through duly authorized local and international providers in accordance with the laws and regulations of each jurisdiction.
These providers may handle specific operations such as transfers, settlements, or currency conversion, maintaining the same standards of compliance, confidentiality, traceability, and transparency.
CoinPay.cr may limit or temporarily suspend access to certain services in countries where local regulations require it, or where regulatory, operational, or reputational risks exist.
CoinPay.cr operates as a Virtual Asset Service Provider (VASP) in accordance with the applicable laws of the Republic of Costa Rica and the recommendations of the Financial Action Task Force (FATF/GAFI).
It complies with the principles established in Article 5, which define the following guidelines:
a) AML/CFT Compliance
CoinPay.cr applies controls equivalent to international FATF standards, implementing Anti-Money Laundering and Counter-Terrorism Financing (AML/CFT) policies, continuous transaction monitoring, and, where applicable, suspicious transaction reporting to competent authorities.
b) Due Diligence (KYC) Policies
Every User must complete identity verification, source of funds verification, and risk assessment before accessing the services.
Each transaction is documented and linked to the User’s KYC file, ensuring full traceability.
c) Operational Transparency
Every transaction made through CoinPay.CR can be verified through documentation, including:
● The blockchain hash
● The fiat currency equivalent at the time of the transaction
● The origin and destination address
● The User’s verified identity linked to the KYC record
d) Exclusion of Non-Transparent Providers
CoinPay.cr does not operate with or maintain relationships with providers or platforms located in high-risk or non-cooperative jurisdictions, nor with services offering anonymization, transaction mixing (mixers/tumblers), or equivalent mechanisms that hinder traceability.
Only authorized or regulated VASPs are used, in accordance with the laws of their respective jurisdictions.
CoinPay.cr services are available only to verified individuals or legal entities of legal age and full legal capacity.
Politically Exposed Persons (PEP)
For regulatory compliance reasons, CoinPay.cr does not accept Politically Exposed Persons (PEP), their relatives, or close associates as clients.
However, on an exceptional and temporary basis, it may provide limited services to certain persons under such condition when it constitutes a civil duty or public interest, under strict compliance supervision and only for the strictly necessary period.
CoinPay.cr reserves the right to reject, suspend, or cancel any account that fails to meet eligibility criteria or presents regulatory or reputational risks.
The User agrees to use the services only for lawful and legitimate purposes.
The use of the platform is prohibited for illicit activities such as:
● Money laundering or terrorism financing.
● Fraud, forgery, or identity theft.
● Tax evasion or capital manipulation.
● Illegal gambling, drug trafficking, or smuggling.
● Unauthorized trading of securities, cryptocurrencies, or derivatives.
CoinPay.cr may suspend, withhold, or close accounts if it detects unusual activity, regulatory noncompliance, or signs of fraud, without prior notice when required by law or compliance obligations.
CoinPay.cr maintains a full commitment to cooperation with national and international authorities in matters of financial, judicial, and tax supervision.
When required by law, CoinPay.cr may provide information, records, or documentation to such authorities within the limits permitted by data protection laws.
CoinPay.cr upholds a policy of full transparency across all its services.
It does not request advance payments for account opening or service access.
Fees, commissions, conversion rates, and applicable terms are provided to the User in a clear and verifiable manner prior to executing any operation.
CoinPay.cr employs bank-grade security infrastructure and protocols, including:
● Data encryption in transit and at rest.
● Multi-factor authentication.
● Continuous access monitoring.
● Regular internal audits.
● Segmentation of sensitive data.
The User is responsible for safeguarding their login credentials and devices.
Any transaction executed using their credentials shall be considered as performed by them.
All content, logos, trademarks, interfaces, software, graphic materials, and texts of CoinPay.cr are the exclusive property of Raw Industries CCM S.R.L. or their respective licensors.
The reproduction, modification, distribution, or unauthorized use of such materials is strictly prohibited.
CoinPay.cr protects user privacy in accordance with Costa Rican data protection laws and international standards such as the General Data Protection Regulation (GDPR), OECD, and FATF.
a) Data Collected
CoinPay.cr may collect the following data:
● Identification information (name, ID, passport, nationality).
● Contact details (email, address, phone number).
● Financial and transactional information.
● KYC/AML verification documents.
● Technical data (IP, browser, device).
b) Purpose of Processing
Data is used exclusively for:
1. KYC/AML and regulatory compliance.
2. Execution of contracted services.
3. Fraud prevention and internal auditing.
4. Customer service and technical support.
5. Operational security and service improvement.
CoinPay.cr does not sell or disclose personal data for advertising purposes.
c) Disclosure and Transfers
Information may only be shared with:
● Authorized financial providers subject to confidentiality.
● Competent authorities, when required by law.
● Compliance or fraud prevention entities.
No data will be transferred to high-risk jurisdictions.
d) Information Security
CoinPay.cr implements technical, physical, and organizational measures to safeguard personal data.
In the event of a security incident, affected authorities and users will be notified.
e) Data Retention and Deletion
Data is retained only as long as necessary to fulfill legal or contractual obligations and is later deleted or securely anonymized.
f) User Rights
Users may request access, correction, or deletion of their personal data, or revoke consent, through CoinPay.cr’s official communication channels.
CoinPay.cr does not guarantee uninterrupted availability or complete absence of errors in its services.
It shall not be held liable for losses arising from:
● Technical failures or network interruptions.
● Errors from third-party providers or financial entities.
● Market fluctuations in conversion rates.
● Force majeure or unforeseeable events.
The maximum liability of CoinPay.cr is limited to the amount of fees actually paid by the User for the corresponding transaction.
CoinPay.cr may modify these Terms and Conditions at any time by notifying users through its website or by email.
Continued use of the service implies express acceptance of such modifications.
These Terms are governed by the laws of the Republic of Costa Rica.
Any disputes shall be resolved before the competent courts of San José, Costa Rica, unless otherwise expressly agreed.
This document constitutes an adhesion contract between CoinPay.CR and the User.
By registering, the User declares that they have read and understood all the terms herein and accepts them fully and irrevocably.
